Pinchart Terms of Use

These Terms of Use ("Terms") govern your use of the Pinchart iOS app (the "iPhone App"), the Pinchart Android app (the "Android App"; each of them, the "App"), the Pinchart website at pinchart.jocoding.io, and related services (the "Service"), operated by JoCoding, Inc., a Delaware corporation ("JoCoding", "we", "us"), 1111B S Governors Ave, STE 80543, Dover, DE 19904, United States. By downloading or using the Service, you agree to these Terms. If you do not agree, do not use the Service.

1. The Service

Pinchart monitors the public App Store and Google Play chart positions of apps you choose to track. It collects Apple's public chart feeds for 175 App Store storefronts (overall Top Free and Top Paid charts, category charts, and Games subgenre charts) about every three hours, as well as public Google Play charts, and shows current positions, rank history, customer reviews, share cards, widgets, and alerts. Pinchart Pro subscribers can also connect App Store Connect with a read-only API key.

Pinchart is an independent tool. It is not affiliated with, endorsed by, or sponsored by Apple Inc. or Google LLC. App Store and App Store Connect are trademarks of Apple Inc. Google Play and Android are trademarks of Google LLC.

2. Ranking data: no guarantee of completeness or accuracy

Ranking information comes from Apple's public feeds and public Google Play charts and is provided as observed. Apple or Google may change, delay, limit, or stop these sources at any time. In particular:

• A feed may return fewer than 100 entries. Pinchart shows the depth it actually observed and does not treat an app missing from a shorter list as ranked below it.
• Some storefront, chart, or category combinations may be unavailable, stale, or not yet collected. Pinchart labels these states instead of showing a rank.
• Observations are taken at intervals, so movements between observations are not captured, and alerts are sent after an observation is processed, not in real time.
• Public charts may differ from the rankings shown inside the App Store or Google Play on a particular device.

The Service is for informational purposes only. Do not rely on it as the sole basis for business, financial, or legal decisions.

3. Free and Pro features

The free version lets you track up to three apps with 7 days of history, browse charts, read reviews, and create share cards. Pinchart Pro adds tracking of up to 50 apps, history beyond 7 days, rank alerts with quiet hours and a daily summary, Home Screen widgets, on-device translation of reviews (with Apple's on-device translation in the iPhone App and Google ML Kit in the Android App), translated reviews on the Website (translated on our server with Cloudflare Workers AI), and the read-only App Store Connect connection. Features may change over time; we will not materially reduce the features of an active paid subscription period without notice. In the iPhone App and the Android App, the free version shows ads served by Google AdMob, as described in the Privacy Policy; Pinchart Pro removes them. A Pinchart Pro account can be signed in on up to three devices or web browsers at a time; signing in on another one signs out the one used least recently. The same free version and Pinchart Pro are available on the Website, in the iPhone App and in the Android App, as described in Section 14.

4. Subscriptions and payment

• Pinchart Pro is offered as an auto-renewable subscription (monthly or yearly). The price is shown in the App before you buy and may vary by country.
• iPhone App (App Store). Payment is charged to your Apple Account at confirmation of purchase. The subscription renews automatically unless it is cancelled at least 24 hours before the end of the current period. Your account is charged for renewal within 24 hours before the end of the current period, at the then-current price. You can manage and cancel your subscription in your Apple Account settings (Settings → [your name] → Subscriptions). Purchases are processed by Apple under Apple's terms, and refunds are handled by Apple according to its policies.
• Android App (Google Play). Payment is charged to your Google Play account at confirmation of purchase, and the subscription is billed and managed by Google Play. It renews automatically at the end of each period at the then-current price until you cancel. You can cancel at any time in the Play Store app (Profile → Payments & subscriptions → Subscriptions); cancellation takes effect at the end of the current period. Purchases are processed by Google under the Google Play Terms of Service, and refunds are handled according to Google Play's refund policies; you can also contact us at mu07010@jocoding.net.
• Deleting the App or deleting your Pinchart data does not cancel a subscription.
• If a free trial or introductory offer is offered, any unused portion is forfeited when you purchase a subscription, where applicable. A free trial turns into a paid subscription at the end of the trial unless you cancel before then.
• Any statutory rights you have remain unaffected.
• You can restore purchases on a new device with Restore purchases in the App. Offer codes can be redeemed in the App (in the Android App, through Google Play's redeem page).

5. App Store Connect connection

If you connect App Store Connect, you confirm that you are authorized to use the API key you provide. Pinchart uses the key only for read-only requests (app list, version state, review status, and available sales reports) and never edits metadata, uploads builds, or changes releases. You can revoke the connection at any time; the stored key is then deleted. You are responsible for the permissions you grant to the key in App Store Connect, and you should revoke the key in App Store Connect if you believe it has been compromised.

6. Acceptable use

You agree not to:

• use the Service in violation of any law or of Apple's or Google's terms;
• attempt to access other users' data, bypass authentication or Pro restrictions, or interfere with or overload the Service (including automated scraping of our API);
• reverse engineer the Service except where the law permits it;
• resell, redistribute, or build a competing data service from data obtained through the Service; or
• use share cards or data to mislead others, for example by altering ranks or presenting them as official Apple data.

We may suspend or limit access if you violate these Terms or if needed to protect the Service.

7. Your content and data

You keep any rights you have in the information you provide. You give us permission to process it only to operate the Service, as described in our Privacy Policy. You can delete your data at any time in the App via Settings → Delete everything, or on the Website by deleting your account (Section 14).

8. Intellectual property

The Service, including its software, design, and share card templates, is owned by JoCoding, Inc. and protected by law. We grant you a personal, non-exclusive, non-transferable, revocable license to use the iPhone App on Apple devices you own or control, subject to these Terms and Apple's Usage Rules, and the Android App on Android devices you own or control, subject to these Terms and the Google Play Terms of Service. App names, icons, and reviews shown in the Service belong to their respective owners.

9. Disclaimer of warranties

To the maximum extent permitted by law, the Service is provided "as is" and "as available", without warranties of any kind, express or implied, including warranties of merchantability, fitness for a particular purpose, accuracy, completeness, and non-infringement. We do not warrant that the Service or the data will be uninterrupted, timely, error-free, or complete.

10. Limitation of liability

To the maximum extent permitted by law, JoCoding, Inc. will not be liable for any indirect, incidental, special, consequential, or punitive damages, or for any loss of profits, revenue, data, or business opportunities, arising from your use of or inability to use the Service. Our total liability for any claim relating to the Service is limited to the greater of the amount you paid for the Service in the 12 months before the claim and USD 50. Some jurisdictions do not allow these limitations, so they may not apply to you; nothing in these Terms limits liability that cannot be limited by law.

11. Termination

You may stop using the Service at any time and delete your data in the App. We may discontinue the Service or any feature. If we discontinue Pinchart Pro during a paid period, we will provide notice and you may request a refund through Apple or Google Play where applicable, or, for a web subscription, from us at mu07010@jocoding.net.

12. Governing law and disputes

These Terms are governed by the laws of the State of Delaware, United States, without regard to its conflict-of-law rules. Courts located in Delaware have jurisdiction over disputes, unless the mandatory law of your country of residence gives you the right to bring proceedings in your local courts or to rely on its consumer protection rules, in which case those rights are not affected.

13. Apple- and Google-specific terms

These Terms are between you and JoCoding, Inc., not Apple. Apple is not responsible for the Service or its content, has no obligation to provide maintenance or support, and is not responsible for addressing any claims relating to the Service. If the App fails to conform to an applicable warranty, you may notify Apple, and Apple may refund the purchase price, if any; to the maximum extent permitted by law, Apple has no other warranty obligation. Apple is not responsible for investigating or defending third-party intellectual property claims. Apple and its subsidiaries are third-party beneficiaries of these Terms and may enforce them against you. You represent that you are not located in a country subject to a US government embargo and are not on any US government list of prohibited or restricted parties.

For the Android App, these Terms are likewise between you and JoCoding, Inc., not Google. Google is not responsible for the Android App or its content, and your use of Google Play is also subject to the Google Play Terms of Service.

14. The Pinchart website

These additional terms apply to the website at https://pinchart.jocoding.io (the "Website"). Features described here that are not yet available apply from the day they become available.

• Accounts. You may sign in with Apple or Google. You are responsible for activity under your account and for keeping your Apple or Google account secure. You may link both providers to one account. The same account can be used in the iPhone App and the Android App, and tracked apps, alerts and Pinchart Pro are shared between them.
• Free and Pro on the web. Signed in on the Website, you get the same free version and the same Pinchart Pro features as in the Apps (Section 3). Pinchart Pro for your account works on the Website whether it was bought on the Website, in the App Store or on Google Play. The Website's public pages (charts, app pages, the niche directory and rank badges) remain available without an account or subscription.
• Web subscriptions. Pinchart Pro can also be bought on the Website as an auto-renewable monthly or yearly subscription, sold by JoCoding, Inc. and billed through Stripe (Stripe Checkout and Stripe Billing). The price, in your currency, and any taxes that apply in your country are shown on the Stripe checkout page before you confirm. The yearly web subscription starts with a 7-day free trial, once per account; an account that already had Pinchart Pro on any platform is not eligible. A payment method is required to start the trial, and the yearly price is charged when the trial ends unless you cancel before then in the customer portal. The monthly web subscription has no free trial. The subscription renews automatically at the end of each period at the then-current price until you cancel. Stripe emails your receipts and invoices and may send renewal reminders and failed-payment notices. If a renewal payment fails, Stripe retries it for a limited time and Pro stays on meanwhile; if it still fails, the subscription ends. You can update your payment method, see invoices or cancel at any time in the Stripe customer portal opened from Settings › Subscription › Manage billing on the Website; cancellation takes effect at the end of the current period. Unless required by law, payments are non-refundable; send refund requests to mu07010@jocoding.net. Your statutory rights, including any right of withdrawal under the law of your country, are not affected. Web checkout may not be available in every country. Subscriptions bought in the App Store or on Google Play are billed and managed by Apple or Google Play under Section 4; a web subscription, an App Store subscription and a Google Play subscription are separate, and cancelling one does not cancel another.
• Automated access. Public pages on the Website show a limited preview. You may not scrape, crawl in bulk, or otherwise extract data from the Website or the web app by automated means, or get around rate limits, bot checks (including Cloudflare Turnstile), sign-in or Pro restrictions. Search engines may index the pages that our robots.txt allows. Assistants you connect to Pinchart (for example ChatGPT or Claude) act for your account within per-account usage limits, and the same rules against bulk extraction apply.
• Cookies and analytics. The Website uses the cookies and local storage described in the Privacy Policy. Analytics and advertising measurement run only after you accept them in the cookie banner, and you can change your choice at any time with the Cookie settings link.
• Termination. You can delete your account on the Website (Settings › Danger zone › Delete account; https://pinchart.jocoding.io/account/delete explains how), in the App with Settings → Delete everything, or by emailing us. We may suspend an account that violates these Terms.

15. Changes to these Terms

We may update these Terms. We will post the updated version with a new effective date and, for material changes, notify you in the App or on the Website before they take effect. Continued use after the effective date means you accept the updated Terms.
